Terms and Conditions (Service Provider)

These Terms and Conditions for the Service Provider (“Agreement”) are concluded between the company AdriaticBooking j.d.o.o. (“AdriaticBooking Company”), with its registered office at Gundulićeva 32, Croatia, and its partners and the Service Provider. This Agreement governs the relationship between AdriaticBooking and the Service Provider. The relationship between the Service Provider and the User is governed by the Agreement between the Service Provider and the User.
1. AdriaticBooking.com Platform
The AdriaticBooking.com platform is operated by AdriaticBooking.com. With regard to the Service Provider’s access to and use of the AdriaticBooking platform, the Service Provider is appointed by AdriaticBooking as its commercial agent for the purposes set out herein. By using the AdriaticBooking platform (i) users may purchase services from the Service Provider through AdriaticBooking as the commercial agent of the Service Provider and (ii) travel agencies, receptionists or other entities may purchase services from the Service Provider for their clients. The Service Provider is responsible for purchasing and maintaining all equipment and connections necessary to access the AdriaticBooking platform at its own expense.
2. Management page for the Service Provider.
The Service Provider may manage its content, including product offerings, on the AdriaticBooking platform through the Management page for the Service Provider.
2.1. Service Provider Account.
The Service Provider shall provide AdriaticBooking with all information necessary for AdriaticBooking to create and maintain a Service Provider account. This includes
- Insurance information in accordance with Section 11,
- Current business license or registration information,
- Payment service provider account information,
- Other information reasonably requested by AdriaticBooking, and
- All information and documents necessary for the identity verification process through Persona Identities Inc. as determined by AdriaticBooking. The Service Provider agrees to provide this information promptly upon activation and to update it via the Service Provider Management Page.
2.2. Login Credentials.
The Service Provider will maintain the confidentiality and security of its login credentials by implementing and adhering to recognized security standards and best practices, such as regularly updating passwords and using multi-factor authentication. The Service Provider may not disclose the login credentials to any third party under any circumstances. The Service Provider is responsible for all activities carried out through its account and must compensate AdriaticBooking for all damages resulting from unauthorized account activities caused by the Service Provider’s failure to protect its login credentials. The Service Provider must immediately notify AdriaticBooking in writing if it knows or suspects that (i) the login credentials have been lost, stolen, misappropriated or otherwise compromised or that (ii) there has been actual or suspected unauthorized use of the Service Provider’s account. This notification must include full details of the incident and the steps taken by the Service Provider to mitigate the damage or unauthorized access.
3. Selling Services on the AdriaticBooking Platform.
3.1. Product Offerings.
For each service that the Service Provider wishes to sell through the AdriaticBooking Platform, the Service Provider will upload a product offering via the Service Provider Management Page. The Product Offer must include all necessary information about the Services, including:
- suitability information (e.g. minimum age, required skills or licenses (e.g. driver's license), level of suitability or inherent risks (including risks for persons with pre-existing medical conditions),
- logistical information (e.g. meeting place, meeting time, duration and required or recommended clothing and equipment) and
- other information requested by AdriaticBooking.
The Service Provider shall ensure that all key information is included in the "Important Information" section of the Product Offer. If any logistical information is omitted from the Product Offer or Ticket, the Service Provider shall provide it to the User as soon as possible. AdriaticBooking reserves the right to make changes to the content in accordance with the AdriaticBooking Content Guidelines.
3.2. Availability.
The Service Provider shall maintain the current and accurate nature of the Product Offer, including availability. The Service Provider shall immediately delete any cancelled or invalid Product Offers. The Service Provider is liable for user complaints based on alleged or actual inaccuracies in the product offer, including availability, or in other content of the Service Provider.
3.3. Prices.
The Service Provider determines the retail price at which the Services are sold to users. The retail price for the Services stated in the product offer and includes applicable taxes. The retail price must include all costs; AdriaticBooking will not collect these amounts separately. The product offer must indicate all fees, taxes, membership fees, commissions or other amounts that will be collected on the date of the provision of the services. The service provider may not charge (or attempt to charge) the user any fees, taxes, membership fees, commissions or other amounts that are not stated in the product offer.
3.4. Conclusion of the contract.
When the user purchases services through the AdriaticBooking platform, they purchase them directly from the service provider based on a contract between the user and the service provider, concluded on the part of the service provider by AdriaticBooking, acting as the service provider's commercial agent on behalf of the service provider. The service provider appoints and authorizes AdriaticBooking (and its distribution partners) as its commercial agent to conclude contracts between the user and the service provider on behalf of the service provider, to manage and cancel reservations and to refund users in full or in part, as specified in this contract. AdriaticBooking may decide to refuse to enter into a contract between the User and the Service Provider at its sole discretion (e.g. in the event of potential fraud or compliance issues).
3.5. Changes.
Users sometimes make mistakes when booking. Depending on availability, AdriaticBooking may change the date, time, language or number of people for a reservation up to two (2) hours after the User has booked the Service. Such changes will be made without charge to the User or AdriaticBooking.
3.6. Billing.
The Service Provider instructs AdriaticBooking as its commercial agent to process payments (in part or in full) from the User on behalf of the Service Provider, and the Service Provider agrees that AdriaticBooking may from time to time, acting at its sole discretion, appoint a commercial sub-agent to receive such payments directly from the User and to forward such payments successfully received to the Service Provider. More specifically, for payments from US users, the Service Provider may appoint any company (New Company) as its limited collection agent solely for the purpose of directly receiving such payments on behalf of the Service Provider and forwarding them to AdriaticBooking. The Service Provider agrees that upon receipt of payment of the amount due from the User by AdriaticBooking or its commercial sub-agent (including the New Company), as the case may be, the User’s obligation to pay the Service Provider shall cease. The Service Provider agrees that any payment made by the User to AdriaticBooking or its commercial sub-agent (including the New Company), as the case may be, through the AdriaticBooking Platform shall be deemed to be equivalent to a payment made directly to the Service Provider and the Service Provider shall provide the Services to the Users in the agreed manner as if the Service Provider had directly received the funds from the User. The Service Provider acknowledges and agrees that it will not seek compensation from the User once the funds are made available to AdriaticBooking or its commercial sub-agent (including the New Company), as the case may be. AdriaticBooking uses the Payment Service Provider to process payments from the User; in some cases a distribution partner, and in certain countries a partner may be appointed as a commercial sub-agent. AdriaticBooking will bear the costs of credit card and bank transaction fees for receiving payments from the User, provided that it may charge the User a foreign currency conversion fee if necessary.
3.7. Subsequent charges and disputes.
If subsequent charges or other unsuccessful payments occur before the Service Provider provides the Service, AdriaticBooking will notify the Service Provider and cancel the reservation. If subsequent charges occur after the Service Provider provides the Service, AdriaticBooking will request a response from the Service Provider within three business days. AdriaticBooking may forward the Service Provider's response to the credit card issuer. The Service Provider acknowledges and agrees that AdriaticBooking receives payments from the User as a commercial agent of the Service Provider and that AdriaticBooking's obligation to pay the Service Provider is subject to and dependent on the successful receipt of the related payments from the User. If there are subsequent debits or other unsuccessful payments:
- AdriaticBooking and its commercial sub-agent will not make payment to the service provider for the reservation to which it relates,
- the company AdriaticBooking will not receive the commission for the reservation to which it refers and
- AdriaticBooking may set off any amount that has already been paid to the service provider for the disputed reservation with a future payment based on this contract.
AdriaticBooking and its commercial sub-agent are not parties to the contract between the Service Provider and the User, do not act as guarantors for the User’s payment and are not liable to the Service Provider in the event of subsequent charges or other non-payment by the User.
3.8. Cancellations; No-Shows.
The Service Provider will not directly accept cancellations of User reservations; all cancellations must be made by the User through the AdriaticBooking platform or AdriaticBooking’s customer service.
(a) During the Free Cancellation Period.
If the User cancels the reservation during the Free Cancellation Period, or at least 24 hours before the start of the reservation, AdriaticBooking will refund the User in full. If AdriaticBooking refunds the User in full based on this section or for any other reason, (A) the Service Provider will not receive payment for the reservation and (B) AdriaticBooking will not receive a booking commission.
(b) After the Free Cancellation Period.
If the User cancels the reservation after the Free Cancellation Period has expired and there are no extenuating circumstances, or within 24 hours from the start of the reservation, the reservation will be considered made for payment purposes. If there are extenuating circumstances, AdriaticBooking may refund the full amount to the user.
(c) Force majeure.
In the event that the service provider cancels the services due to force majeure, the service provider must immediately notify AdriaticBooking's customer service. The user may cancel the reservation due to force majeure at the travel destination, regardless of whether the service provider continues to provide the services during the period of time to which it applies. If the service provider or the user cancels the reservation due to force majeure, AdriaticBooking will refund the full amount to the user.
(d) No-shows.
If the user does not show up and there are no extenuating circumstances, the reservation will be considered completed for payment purposes. If there are extenuating circumstances, AdriaticBooking may refund the full amount to the user.
3.9. Failure to perform services.
If the service provider cancels the reservation or fails to provide the services to the user based on the reservation, AdriaticBooking will refund the full amount paid by the user. The Service Provider acknowledges that cancellation or non-performance of the Services jeopardizes the goodwill and reputation of AdriaticBooking and causes additional customer service costs for AdriaticBooking. Accordingly, if AdriaticBooking determines that the cancellation or non-performance of the Services is not justified (e.g. as a result of a force majeure situation), AdriaticBooking may deduct a cancellation fee (as contractual damages) in the amount of 35% of the retail price of the Services for each affected User from any future payment due to the Service Provider.
3.10. Provision of Services.
The Service Provider shall provide the Services in accordance with the Product Offering, in good faith and in accordance with the best practices and standards in the tours and activities industry. The Service Provider may subcontract the performance of the Services only with the prior written consent of AdriaticBooking.
4. Payment.
4.1. AdriaticBooking's Commission.
The Service Provider agrees to pay AdriaticBooking a commission for:
- the use of the AdriaticBooking platform,
- the marketing performed by AdriaticBooking,
- the customer service provided by AdriaticBooking,
- the mediation of AdriaticBooking in transactions between the Service Provider and the User, and other services performed by AdriaticBooking under this Agreement.
The AdriaticBooking commission is a percentage of the retail price for the reservation as stated in the Service Provider's invoice. The Service Provider agrees to keep the amount of the commission confidential. The commission will be deducted from the retail price charged to the Users in the agreed currency for the increased corresponding VAT rate.
4.2. Payment to the Service Provider.
AdriaticBooking will pay the Service Provider once a month. The Service Provider will have the right to choose the currency from the list of available currencies in which it wishes to receive payments. The Service Provider may change the payment currency at any time.
Monthly payment.
By the fifth business day of the month, AdriaticBooking will transfer to the payment service provider an amount equal to:
the total amount charged to users for reservations made in the previous month, less the applicable commission and a Stripe processing fee (https://stripe.com/en-hr/pricing)
4.3. Taxes.
The Service Provider is solely responsible for determining its obligations to report, collect and pay all applicable taxes or to include them in its product offerings and for paying all applicable taxes to the appropriate government authority. If AdriaticBooking is required to collect applicable taxes on behalf of the Service Provider, the Service Provider will notify AdriaticBooking of the applicable rates and the parties will cooperate to determine the method of collection. If AdriaticBooking at any time determines that it is required to collect or withhold applicable taxes in connection with the Services, either alone or on behalf of the Service Provider, it will notify the Service Provider and collect or withhold such applicable taxes.
Upon request by AdriaticBooking, the Service Provider will within five business days:
- provide valid tax identification numbers, including a business registration number if applicable,
- issue a valid tax invoice,
- provide documentation of taxes paid, and
- provide further cooperation regarding tax compliance.
4.4. Transaction Fees; Deductions.
AdriaticBooking shall pay the transaction fees charged by AdriaticBooking's or its commercial sub-agent's financial institution for the transfer of funds to the payment service provider's account. The service provider shall pay all fees charged by the service provider's financial institution for the receipt of payments from AdriaticBooking or its commercial sub-agent and, if applicable, all fees charged by the intermediary bank. AdriaticBooking or its commercial sub-agent may deduct from any payment to the service provider the costs of refunds to users, replacement services provided to users or other amounts that the service provider must pay or reimburse AdriaticBooking under this agreement.
4.5. Report.
AdriaticBooking will provide a report to the Service Provider once per payment period (depending on the cooperation model), stating:
- the total number of reservations made during the payment period,
- the total amount charged to users on behalf of the Service Provider for the reservations made,
- the total amount transferred to the Service Provider’s account for payment for those reservations made,
- the services performed by AdriaticBooking (“Commission”), and
- the amount of sales tax or other taxes collected and paid on behalf of the Service Provider (if any).
The report shall be the basis for payment to AdriaticBooking. Item (d) shall serve as an invoice issued by AdriaticBooking to the Service Provider in connection with the services provided (“Commission Invoice”). If the Service Provider does not provide AdriaticBooking with a written notice in good faith regarding the report, including reasonable details supporting such dispute, within thirty (30) days of receipt of the report, AdriaticBooking shall be deemed to have accepted the report. After such period, AdriaticBooking shall correct any discrepancies at its sole discretion. Without prejudice to the above, no disputes, requests or procedures regarding payment can be initiated against AdriaticBooking after:
- the expiration of one (1) year from the date payment is due (or deemed due) or
- in the case of multiple payments, after the expiration of one (1) year from the date on which the first of such payments became due (or was deemed due).
4.6. Calculation of payment.
Without prejudice to anything to the contrary in this agreement, AdriaticBooking and its commercial sub-agent may delay and calculate payments to the service provider until the total amount payable is at least EUR 40.00 (or an equivalent amount in the specified currency). AdriaticBooking will transfer all calculated and unpaid amounts to the service provider after termination of this contract.
4.7. Withholding of payment.
AdriaticBooking and its commercial sub-agent may postpone or withhold payments due to the Service Provider in the event that the Service Provider fails to provide the mandatory information specified in sections 2.1. and 4.4. of this Agreement.
5. Relations with Users.
5.1. Communication with Users.
The Service Provider may not directly or indirectly:
- encourage the User to book the Service outside the AdriaticBooking Platform,
- refer the User to another website or platform, including the Service Provider's website or platform, or
- take any other action to circumvent the AdriaticBooking Platform or the payment of commissions.
If potential Users who have initiated communication via the AdriaticBooking Platform request to book the Service outside the AdriaticBooking Platform, the Service Provider will refer them to the AdriaticBooking Platform.
5.2. Communication via the AdriaticBooking Platform.
The service provider must check messages received via AdriaticBooking's communication tools at least once a day and respond to user inquiries within the following timeframes:
- If the user contacts the service provider more than 7 days before the start of the services: the service provider must respond to the user within 48 hours.
- If the user contacts the service provider from 2 to 7 days before the start of the services: the service provider must respond to the user within 24 hours.
- If the user contacts the service provider up to 2 days before the start of the services: the service provider must respond to the user before the start of the services.
The service provider must respond to AdriaticBooking's inquiries within 24 hours. The service provider may not use the communication tools on the AdriaticBooking platform or the information provided on the AdriaticBooking platform to:
- distribute unsolicited commercial messages or promotions,
- contact the user for purposes unrelated to the service,
- make or accept reservations that circumvent the payment of commission,
- request or receive payments for services without using the AdriaticBooking platform, or
- transmit prohibited content.
The service provider acknowledges that messages sent via the communication tools or the AdriaticBooking platform may be monitored for quality control purposes and may be stored by AdriaticBooking. AdriaticBooking may delete or block messages that violate this Agreement.
5.3. Service Levels and Business Conduct.
The Service Provider undertakes to act with the care of a normal and reasonable business towards all users. The Service Provider guarantees that the retail prices, availability, features and limitations of the services offered through the AdriaticBooking platform will be equal to or better than those offered by the Service Provider or its partners through their online stores. Users who book a service through the AdriaticBooking platform will be treated equally to users who book through other channels of the Service Provider or its partners.
The Service Provider confirms that AdriaticBooking has provided it with access to written guidelines for responsible tourism that define ethical standards, human rights, sustainable development, and norms against bribery and corruption. The Service Provider undertakes to operate in accordance with the Guidelines for Responsible Tourism and all applicable laws and regulations. If the Service Provider fails to meet these conditions, AdriaticBooking may terminate this Agreement.
5.4. Invoices.
At the request of the User, the Service Provider must issue an invoice for the Services to the User via the communication tools on the AdriaticBooking platform. The invoice must comply with all applicable tax requirements.
5.5. Tickets and invoices.
The Service Provider must accept the User’s tickets generated by AdriaticBooking, including printed tickets and tickets displayed on smartphones or other mobile devices. The Service Provider must issue an invoice for the Services to each User upon their request, which must comply with applicable tax requirements.
5.6. User requests.
The Service Provider is responsible for managing the User’s requests and complaints regarding the Services, the Service Provider’s personnel and refund requests. If the Service Provider does not respond to the User’s complaint within three business days, AdriaticBooking reserves the right to refund the User in full.
If the user files a complaint due to non-conformity of the services with the product offer or for other reasons, AdriaticBooking may decide to:
- refund the user in full or in part,
- offer the user alternative services (of the same or better standard) and deduct the costs of such alternative services from future payments to the service provider.
5.7. Conduct of staff.
The service provider is solely responsible for the conduct of its staff towards users and other persons. The service provider shall not discriminate or harass users on the basis of race, origin, religion, gender, disability, age, sexual orientation or any other basis. The service provider shall ensure that the same applies to its staff.
5.8. Reviews.
Users have the right to leave reviews of the services via the AdriaticBooking platform. These reviews serve to collect feedback on the services and the service provider. All reviews remain the exclusive property of AdriaticBooking. The service provider is not allowed to use or distribute reviews. AdriaticBooking reserves the right to remove reviews that do not comply with its rules.
The Service Provider may not manipulate the review system, including writing its own reviews or hiring third parties to write reviews.
6. Marketing.
6.1. Obligations of AdriaticBooking.
AdriaticBooking will promote the Service Provider's services at its own discretion. This includes online and offline promotions, email marketing and paid-per-click advertising. The ranking of the Services on the AdriaticBooking platform is determined at the discretion of AdriaticBooking.
AdriaticBooking may grant a discount on the retail price of the Services, provided that the amount of the discount is borne by AdriaticBooking through a reduction in its commission.
6.2. Obligations of the Service Provider.
The Service Provider must offer the Services under its usual trade name or brand. The content of the offer must not imply that AdriaticBooking provides the services or guarantees their quality.
6.3. Communications of the Service Provider.
The Service Provider must not contact users for marketing or promotional purposes without their prior consent. Also, it is not allowed to include promotional materials in confirmations or other communications with users.
6.4. Development.
AdriaticBooking may share the content of the Service Provider and information about it with distribution partners in order to promote the services and improve the AdriaticBooking platform. This includes the transfer of data for the purpose of promoting the services through map providers, directories, search engines or digital assistants, as well as the development of interfaces for integration with third parties.
The Service Provider acknowledges that AdriaticBooking is not responsible for the accuracy of the data or services provided by third parties through these integrations.
7. Compliance.
The Service Provider undertakes to ensure compliance with all applicable laws and regulations, including:
- Consumer protection and safety laws.
- Licensing and business regulations.
- Health and safety standards, including specific requirements related to COVID-19 or other communicable diseases.
Upon request by AdriaticBooking, the Service Provider must provide documentation proving compliance, including permits, licenses and certificates. In the event of alleged non-compliance, the Service Provider will promptly cooperate with the relevant authorities or bodies to resolve the issue.
8. Intellectual Property.
8.1. Service Provider Content.
The Service Provider grants AdriaticBooking a global, non-exclusive license to use its content (texts, images, videos, product offers) for the purposes of promotion, translation and distribution. The Service Provider retains ownership of its content, but is responsible for ensuring that there is no violation of copyright or other laws.
AdriaticBooking may modify, translate or adapt the Service Provider Content to improve the user experience, while reserving the right of the Service Provider to request correction of any errors.
8.2. Restrictions.
The Service Provider undertakes not to:
- Collect data from the AdriaticBooking platform using automated tools.
- Attempt to circumvent the security measures of the AdriaticBooking platform.
- Decrypt, copy or use the platform software in a manner that is not authorized.
8.3. Service Provider Trademarks.
The Service Provider grants AdriaticBooking the right to use its trademarks for marketing purposes, free of charge. These rights do not transfer ownership, but rather enable AdriaticBooking to promote the Service Provider's services.
9. Representations and Warranties.
9.1. The Service Provider warrants:
That it owns the rights to the content and services it provides through AdriaticBooking.
- That its content and services do not violate laws or the rights of third parties.
- That all information in the product offer remains true, accurate and complete.
- That all services will be performed in accordance with applicable laws and industry standards.
9.2. Disclaimer.
AdriaticBooking provides its platform “as is” and does not guarantee that the platform will be free from errors, interruptions or technical difficulties. Also, AdriaticBooking does not guarantee a minimum number of reservations for the Service Provider.
10. Indemnity.
The Service Provider shall indemnify AdriaticBooking for all costs, damages or losses resulting from:
- Complaints by users about the Service Provider’s services.
- Violations of laws or third-party rights.
- Problems related to the Service Provider’s content.
AdriaticBooking reserves the right to defend itself against third-party claims in cooperation with the Service Provider.
11. Insurance.
The Service Provider must insure its business and services with coverage that is in accordance with industry standards. The insurance policy must cover:
- Damages related to the provision of services.
- Automobile liability if the services include transportation.
Upon request by AdriaticBooking, the Service Provider must provide proof of insurance and update the policy details.
12. Liability.
12.1. AdriaticBooking's limitation of liability.
AdriaticBooking shall only be liable to the service provider for damages arising directly from:
- Intentional or gross negligence of AdriaticBooking.
- Injury, death or health problems caused by AdriaticBooking's negligence.
- Breach of essential contractual obligations of AdriaticBooking.
In cases of negligence, AdriaticBooking's liability is limited to foreseeable damages arising from the nature of the contract. AdriaticBooking shall not be liable for:
- Loss of data not caused by regular backups by the service provider.
- Problems caused by force majeure, platform maintenance or events beyond the control of AdriaticBooking.
- Actions of distribution partners.
13. Data protection.
13.1. Data controller.
AdriaticBooking and the service provider act as separate data controllers. The personal data of the user (name, address, contact details, etc.) that Adriatic Booking shares with the Service Provider may only be used for the performance of the Services to the Users.
13.2. Data Security.
The Service Provider must:
- Comply with applicable data protection laws, including the GDPR.
- Maintain technical and organizational measures to protect the Users' personal data.
- Provide evidence of compliance with security measures and laws upon AdriaticBooking's request.
13.3. Payment Processing.
The Service Provider authorizes AdriaticBooking and its payment service providers to process transaction data necessary to transfer funds to the Service Provider's accounts.
14. Duration and Termination.
14.1. Duration of the Agreement.
This Agreement shall enter into force on the date of acceptance and shall remain in force until terminated by one of the Parties in accordance with the provisions of the Agreement.
14.2. Termination without cause.
Either Party may terminate this Agreement with 30 days' prior notice.
Deactivation of the Service Provider's account shall be deemed termination of the Agreement.
14.3. Termination for cause.
The Agreement may be terminated immediately in the event of:
- Breach of contractual obligations not remedied within 15 days of notification of the breach.
- Serious complaints by the User regarding the Service Provider's services.
- Non-compliance of the Service Provider with applicable laws.
14.4. Effects of termination.
After termination, all remaining reservations of the User must be fulfilled or resolved in accordance with AdriaticBooking's rules. The Service Provider's content will be removed from the platform after the expiration of all reservations.
15. Distribution partners.
15.1. Cooperation with travel agencies.
Certain AdriaticBooking distribution partners act as travel agencies. The following rules apply to reservations made by travel agencies:
- The User purchases the services from a travel agency and not directly from the Service Provider.
- The travel agency may collect payments from the user on behalf of the service provider.
- AdriaticBooking is not responsible for the actions of the travel agency, unless otherwise stated.
16. Connections and technical integrations.
16.1. Connection partners.
The service provider may use third parties to connect to the AdriaticBooking system. In this case:
- AdriaticBooking may share confidential information with connection partners to facilitate reservation management.
- The service provider is responsible for ensuring that the connection partner protects the data in accordance with the contract.
16.2. API integrations.
If the service provider uses its own API for integration with AdriaticBooking, it must:
- Provide technical support for the smooth functioning of the integration.
- Protect data from loss, unauthorized access and modification.
17. General.
17.1. Applicable law.
This contract is governed by the laws of the Republic of Croatia. The exclusive jurisdiction for disputes shall be in the courts according to the seat of AdriaticBooking.
17.2. Confidentiality.
The parties undertake to maintain the confidentiality of all data and information obtained during the term of this agreement, unless required by law or competent authorities.
17.3. Force majeure.
The parties shall not be liable for failure to perform obligations caused by force majeure, including natural disasters, war, epidemics and similar circumstances.
*in exceptional situations, AdriaticBooking may allow the Service Provider to act as the final Executor. In such cases, Adriatic Booking shall agree on a specific form of cooperation for which not all of the conditions of this document apply.
